1. Overview and acceptance

This website and online store are operated under the Cyber Monkey Junkies brand. Throughout these Terms of Service, “Cyber Monkey Junkies,” “we,” “us,” and “our” refer to the operator of this storefront. Shopify provides the commerce platform that enables us to offer products and services to you.

These Terms of Service apply to your access to and use of this website, related content, features, tools, products, and services (collectively, the “Services”). By visiting the site, creating an account, or purchasing from us, you agree to these Terms and to the policies incorporated by reference. If you do not agree, do not use the Services.

Nothing in these Terms limits rights that cannot legally be waived under applicable consumer-protection law.

2. Online-store terms and customer responsibilities

You may use the Services only for lawful purposes. You represent that you are legally able to enter into a binding agreement in your jurisdiction or that you use the Services with the permission and supervision required by applicable law.

You are responsible for providing accurate, current, and complete information, including billing, shipping, and contact information. You are responsible for reviewing order details before submitting an order and for keeping account credentials confidential.

3. Product information

We work with third-party suppliers, manufacturers, print providers, warehouses, carriers, and other service providers. Unless expressly stated, products are not manufactured by Cyber Monkey Junkies, and third-party brand names remain the property of their respective owners.

We try to present useful and accurate product information, but supplier-provided specifications, packaging, images, and availability may be updated. Product colors may vary slightly because of screens, lighting, photography, production runs, and supplier updates. Packaging may change without notice. Images are illustrative of the product but may not reproduce every color or detail exactly.

We do not claim that every product has been personally tested or that every supplier specification has been independently verified. Please review the product page and contact us before ordering if a particular specification is essential to your intended use.

4. Pricing, availability, and corrections

Prices, promotions, product descriptions, specifications, shipping options, and availability may change without notice, subject to applicable law. We may correct errors, inaccuracies, or omissions and update or cancel affected information or orders when reasonably necessary.

If we cancel an order after payment has been captured and no product will be fulfilled, we will issue an appropriate refund to the original payment method.

5. Orders, acceptance, and cancellation

Submitting an order is an offer to purchase. We may accept, reject, limit, or cancel an order for reasons including product unavailability, pricing or description errors, suspected fraud, payment problems, shipping restrictions, legal or safety concerns, or fulfillment limitations.

You may request cancellation before fulfillment begins. Cancellation cannot be guaranteed after an order has entered processing or shipped. Our Shipping Policy and Refund and Return Policy provide additional details.

6. Billing and account information

You agree to provide accurate payment and account information and to update it when necessary. You authorize the applicable payment provider to charge the amounts shown at checkout, including disclosed taxes, shipping charges, and other fees.

We may limit or cancel quantities purchased per person, household, account, payment method, billing address, shipping address, or order where reasonably necessary. We may contact you using the information supplied with the order to verify or resolve a transaction.

7. Shipping, returns, and refunds

Shipping times are estimates, not guarantees. Products may be fulfilled from different domestic or international locations and may arrive in separate packages.

Please review our Shipping Policy and Refund and Return Policy, which are incorporated into these Terms. If a conflict exists, mandatory rights under applicable law control.

8. Third-party suppliers, services, and links

We may rely on third parties to host the store, process payments, provide products, fulfill orders, ship packages, analyze site usage, or provide other services. Your order remains with Cyber Monkey Junkies; contact us first for customer support.

The Services may include third-party tools, content, or links. We do not control every third-party website or service and are not responsible for its independent content, availability, privacy practices, or terms. Use of third-party services may be subject to separate terms.

9. Intellectual property

The Cyber Monkey Junkies name, original character artwork, logos, site design, original written content, graphics, and other brand materials are owned by or licensed to the storefront operator and are protected by applicable intellectual-property laws. Third-party product names, images, trademarks, and materials remain the property of their respective owners.

You may use the site for personal, noncommercial shopping purposes. You may not copy, reproduce, distribute, sell, exploit, or create derivative works from protected site content without prior written permission or another lawful basis.

10. Feedback and submissions

If you voluntarily submit feedback, ideas, reviews, or other content, you grant us a nonexclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and display that submission in connection with the Services, subject to applicable law and our Privacy Policy. You represent that you have the right to submit the content and that it does not violate another person’s rights.

We may remove content that is unlawful, fraudulent, abusive, misleading, infringing, or otherwise inappropriate.

11. Prohibited uses

You may not use the Services:

For an unlawful, fraudulent, abusive, or deceptive purpose;
To violate intellectual-property, privacy, publicity, or other rights;
To transmit malware, malicious code, or destructive content;

We may suspend or terminate access for a prohibited use.

12. Disclaimer of warranties

To the fullest extent legally permitted, the Services and products are provided on an “as available” and “as is” basis, except for express warranties stated in writing and rights that cannot legally be excluded. We do not guarantee uninterrupted or error-free access, a particular commercial result, or delivery by a guaranteed date.

Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.

13. Limitation of liability

To the fullest extent legally permitted, Cyber Monkey Junkies and its service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, savings, data, goodwill, or replacement costs arising from use of the Services or products.

Where liability cannot legally be excluded, it will be limited only to the extent permitted by applicable law. This section does not exclude liability or remedies that cannot legally be limited.

14. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Cyber Monkey Junkies and its service providers from third-party claims, liabilities, damages, and reasonable costs arising from your unlawful use of the Services, your breach of these Terms, or your violation of another person’s rights.

15. Privacy

Our collection and use of personal information are described in our Privacy Policy. Shopify also processes information required to provide the commerce platform and checkout services.

16. Severability

If any provision of these Terms is found unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted and severed to the extent necessary. The remaining provisions will continue in effect.

17. Termination

These Terms remain effective unless terminated by you or us. You may stop using the Services at any time. We may suspend or terminate access if we reasonably believe you violated these Terms or applicable law. Obligations and liabilities incurred before termination, and provisions that by their nature should survive, will remain effective.

18. Entire agreement and waiver

These Terms and the policies posted on the site constitute the entire agreement between you and Cyber Monkey Junkies concerning the Services, except for terms that cannot legally be modified or waived. A failure to enforce a provision is not a waiver of that provision.

19. Applicable law

These Terms are governed by applicable law. We do not designate a specific governing jurisdiction in these Terms. Mandatory consumer-protection rights and other rights that cannot legally be waived remain in effect.

20. Changes to these Terms

We may update these Terms by posting a revised version on this page and changing the “Last updated” date. Changes apply prospectively except where applicable law permits or requires otherwise. Your continued use of the Services after an update constitutes acceptance to the extent permitted by law.
